R sir i put a complaint against a clerk for demanding of bribe. Due to pending Inquiry the department withheld the clerk promotion but now i got the information through RTI that school Principal issue a false certificate of regarding
" no inquiry pending" . School principle knows the matter that inquiry is pending against this clerk but Principal is in the favor of clerk so he issue him a false certificate that no inquiry is lying pending against that clerk . so with the help of this false certificate department gave him promotion .
So after that i put a departmental complaint to punish that Principal with a bundle of proof. After the departmental inquiry they said that this is not done knowingly and shows a clerical mistake. i am not satisfied with the departmental finding so tell me whether i can put Istagaasa in the lower court under section 200 of IPC because the fake no inquiry certificate is issued to clerk only to gave him benifit and this is done knowingly and i have a bundlle of proof . so advice me

मेरा सबसे बड़ा सबूत यह है की मैने 2 साल पहले ही इस प्रिंसिपल को इस क्लर्क को नो इन्क्वायरी सर्टिफिकेट जारी ना करने के लिए ईमेल डाली थी और इस क्लर्क की चल रही पड़ताल बारे फोटो कापी भी भेजी थी क्योंकि मुझे पहले से ही पता था कि इस क्लर्क को फायदा देने के लिए यह प्रिंसिपल झूठा सर्टिफिकेट जरी करेगा और इस ने फिर भी सर्टिफिकेट जारी कर दिया ।

The following particular questions arise out of your query, as you did not give proper background of the case:
1) Inquiry was pending with whom against the clerk?
2) What do you understand about the term, "pending inquiry"?
3) Was any charge sheet issued against the clerk on your complaint and decision pending?
4) Had the clerk committed such a criminal offence that he was punishable with imprisonment?
5) Was the principal knowing that on your complaint there was likelyhood that he will thereby facilitate the commission of an offence punishable with imprisonment, as per the provisions of Sec.200?

Regarding your subsequent post, "मेरा सबसे बड़ा सबूत यह है की मैने 2 साल पहले ही इस प्रिंसिपल को इस क्लर्क को नो इन्क्वायरी सर्टिफिकेट जारी ना करने के लिए ईमेल डाली थी," on what ground the principal was obliged to adhere to your direction? Was the principal working as your subordinate to adhere your direction about not to issue "no inquiry certificate," if no charge sheet was issued against the clerk by the department or no court case was filed by you or police against the clerk?

Vague query , demanding of bribe is not an offence , giving and taking of bribe attracts offence under poc act .

Your email to principal cannot be treated as evidence unless the principal was aware of the pending disciplinary case on issue of a formal charge sheet by the department or pending court case against the clerk. That could be treated just as an intimation about your pending complaint case. On pending complaint case, unless charge sheet is issued on initial investigation, departmental obligations cannot be held in abeyance to the disadvantage of the employees.

मैंने प्रिंसिपल को जो ईमेल भेजी थी उसमे मैने उसको डिपार्टमेंट की तरफ से आए summon आर्डर की कॉपी भेजी थी तथा प्रिंसिपल ने खुद इन्क्वायरी में अपने biyan दर्ज करवाए है और वो कॉपी भी मैंने ईमेल पर भेजी थी ।जब प्रिसिपल को पता था की शिकायत की पड़ताल चल रही है तो वो किस तरह कह सकता है की पड़ताल पेंडिंग नहीं है । उस ने जो सर्टिफिकेट जारी किया है उस मै यह लिख कर दिया है की इस क्लर्क के खिलाफ कोई शिकायत या पड़ताल panding नहीं है । अब यह बतायो की उस ने सही सर्टिफिकेट दिया है या गलत दिया है ?

Unless you reply my queries, any other supplement to you post is irrelevant, as I know you are just misinterpreting the term, "inquiry."
Your statement, "क्लर्क की चल रही पड़ताल बारे फोटो कापी भी भेजी थी'" does not indicate who was doing investigation or inquiry (in your own term)? Also "summon" in whose name, whether in your name, clerk's name or in principal's name and by police or by court of law?
I believe, you are overlaiden by your own misconceptions about inquiry as well as law.

क्लर्क की शिकायत की पड़ताल शिक्षा विभाग का जिला शिक्षा अधिकारी कर रहा था और उस अधिकारी ने स्कूल प्रिंसिपल को पड़ताल में बियान देने के लिए summon भेजे थे । इसलिए जब प्रिंसिपल शिकायत में बियान दे रहा है फिर भी कह रहा है की शिकायत या पड़ताल पेंडिंग नहीं है ।

As per your clarification, the case is still in the investigation stage. Until any charge sheet is issued, he cannot be treated as guilty and the principal was not obliged to work on your direction.
You should know that for the purpose of promotions, certificate of "no disciplinary case is pending" is required, NOT of "no inquiry pending." Any disciplinary case starts only after issue of charge sheet for departmental inquiry. For more knowledge, you may better study ruled on conduct & discipline for employees and rules of promotion of your department.
