Child custody

(Querist) 27 September 2014 This query is : Resolved 
Beyond all my allegations of my husband raised for get divorced from me and get the only son's(9 Years) custody, and as per the latest court order to give the child for weekend to his father but child is strongly opposing to meet his father, to talk with and even he refused to accept any gift from his father. my in-laws are creating violence at our doorstep. i too take out an order of not to allowed them in my house premises at 144(2) act. my son also has injunction from court no to go out of kolkata. but suspecting some violent situation i am stealthy going my uncle's house.

My question is ...is there any law to protect my son from this situation. Upto to the next appeal to court?

If the child is unwilling to visit his father/home, apply to the Court granting visitation rights of father and state the fact to the court, his (father's) visitation right shall be withdrawn/ cancelled.

You can prey the court for permitting the visiting tights at court premises or at any other convenient place once in a month. Also inform the court that the child is not ready to visit his father's home and their family is trying to create violence.

In an application to be moved immediately before the court which granted the visitation rights, narrate the facts in an affidavit and seek cancellation of the interim order immediate forthwith. You may add essence to your application giving the details of your husband side hooliganism etc.,
