My mother have a piece of land received from inheritance. All the papers of that property are with us and we are also paying tax. Recently we have constructed boundary wall on that land. Now a man filed a case against my mother saying that his land has been encroached by us. It has been learnt that some portion of that land was sold by a third person to that man who is claiming now. Please suggest what should we do?

Beware the person being third party has a defective title as he did not purchase it from lawful owner. But if he sells the land to fourth party then fourth party is not bound by claim of your mother.
So have to act fast.

You have to contest the case before the court by bringing on record your documents and how you have not encroached any land, rather you have confined yourself within your portion. Needless to say, you have to engage a lawyer to represent you before the Court.

Dear Author First Confirm Your self by obtaining the Copy of Documents Regarding the Forgery from Registrar Office and also obtain EC also. Then Consult A Good Local Advocate and First File a Police Complaint For Land Grabbing for a Speedy Remedy.

Take the help of a local lawyer, discuss the issue with him by perusing all the related papers and proceed as per his advise. Without seeing the documents/papers, it will be difficult to give any opinion to your issue.

When a case is already filed in court, you need to contest it,so get a local lawyer engaged.
