Crp in high court against the pending civil suit in the lower court

Respected Learned Lawyers, I filed a civil suit in the lower court to annul the fraudulent registrations made on my ancestral property. The suit is prolonging for four long years. Though all the respondents have been declared ex-parte, one of the respondent who is a power agent and a fraudulent person is creating trouble by submitting invalid petitions and wasting the precious court time & prolonging the case. He appealed by submitting IA petition to set aside the ex-parte order after three years of the order. It got dismissed after a period of more than 3 months. Then he submitted another petition telling that he is submitting a revision petition and prolonged the issue. When that too was rejected, he is appealing now saying that he wants to file CRP in the High Court and seeks time. No doubt that every person has the right to appeal. But the fraudulent person should not be given any chance and that too without any ground.
In my case, the person dragging the matter is a Power Agent. When the other persons who claim right on the property fraudulently are keeping quite, on what basis the Power Agent can seek relief ? Can the court admit the CRP by the power Agent ?

The Power Agent could represent the case supported by valid reasons for the Non Appearance of actual persons.Better Consult a Senior Advocate of your place and proceed.

Thank You Mr. Rajkumar for your valuable advice. Actually, the power agent is another fraudulent person who got the Sale Deed Registered after the cancellation of the GPA and he hurried the registration knowing very well that GPA has been cancelled. He cannot approach the person who gave him the GPA. All the facts clearly brought in my petition to the court. It is a pity that court is considering despite the facts stated in my affidavit.
