Slp against order passed by ncdrc

(Querist) 28 June 2015 This query is : Resolved
I am the Respondent in an SLP filed by the opposite Party in SCI. I understand that SLP denotes 'Special Leave Petition to Appeal'. Should the SLP - which is due for hearing shortly be admitted then will the matter go for appeal hearing or does the case gets closed then & there and we lose?
Anirudh (Expert) 28 June 2015
On the day of admission anything an happen - like (i) the SLP may get dismissed; (ii) Notice may be issued.

If the SLP gets dismissed - that is the end of the story.

If the notice is issued, then upon receipt of reply from the respondent, it will be decided whether to grant leave or not.

If leave is granted, then it means SLP is admitted. In that caser, SLP will get converted into Civil Appeal. One has to wait for regular hearing. It will take minimum 3-4 years.

1.if SLP is dismissed by SC matter ends there.

2. if SLP is admitted then notice be issued to you for next date and you will have to defend it in SC with help of lawyer.
