Sir the court has awarded compensation in a cheque bounce case to me but accused failed to compensate.Now can I file execution petition to recover it with interest @ 18% per annum from accused?

Dear friend If you have filed a case before the civil court then your opposite party need to be addressed as defendant and not the accused person. Now if you have got a decree from the civil court then you will have to get your decree executed for sure.

As it is a cheque bounced case, I presume u had filed criminal case and obtained order for compensation. If the accused failed to pay the compensation amount, u may file contempt application before the magistrate's court which passed the order.

can file recovery petition in civil nature n get order executed ..NI Act case may b either in civil or criminal, but getting order executed must b in civil by recovery petition .
