Dear All,
Hope you all are doing good.
I have one query regarding m resignation, i have resign my company in 31.07.2014 but my senior have non accepted the resignation stating reason
"With reference to your trailing mail and the discussions I had with you today morning we would like to mention the following:
1. Your resignation has not been accepted by the management.
2. Shortage of cement with value of more than Rs 2 crore has been observed at Raipur, out of which C&F Raipur has paid only Rs 45 lacs so far,
Hence you have to continue with your regular duties, at least upto the time the entire payments against cement shortage are released by M/s XYZ."
Now its around more than one year from the incident and now having O/S of 85 Lacs (Excluding 30 lacs security of C&F).
Can i now leave the company with stating the issue, as my notice period of two month is already clear.
I have already taken no dues letter from the C&F.
Please suggest what to do now.

They are alleging shortage of cement to the extent of Rs. 2 crore and more.
What is this shortage about?
In other words, they are making allegations of very serious nature against you.
Therefore, without knowing what is the entire matter is about, it will not be possible to give answer to your query.

When we do audit, we found that material was short in stock as compare to the book record.

Then what is your explanation for that?
Are you in charge and responsible for that?

I am the in charge but due to high inflow and huge stock at godown ever time (even the senior officer and internal auditor have mention in the visitor book, not in countable position due to huge stock) every time.

Then in that case give appropriate reply to the mail received from them and one more time ask for relief, by stating that your notice period is already over.

In this thread you have mentioned the matter is one year old.
Other thread by querist:
http://www.lawyersclubindia.com/experts/Regarding-non-acceptance-of-resignation-stating-reason-556216.asp#.VeAtIX1-jMo
This thread is initiated on 25th August, 2015 and worded in a manner that the matter looks like as if querist has to resign.
The querist has not replied to any of the points raised by experts.
In both threads apparently there is a mismatch.
You seem to have accepted the communication of your senior officials and stayed in the company after expiry of notice period.
You may have to tender fresh notice/resignation.
The comments of internal auditors, apparently have not been accepted by senior management.
It shall be certainly appropriate to show all documents and records to an able Labor Law Consultant/Service Matters lawyer/Law Firm, and proceed further after understanding merits and options.

I have a gain tender my resignation on 31St Aug mentioning my last date of working 5th Sep and my Sr. G.M reply that you have given very short notice period as your notice period is of 3 month. And acceptance of resignation is management decision and you have to wait for 4 to 5 days. But now it's one month and I have no get any reply from them and even they hold my Aug'15 salary as I already serve Sep'15 in company....
Please advise what to do now and can I send some mail for salary stating that I am accepting that company accepted my resignation and it will be settle in finalsettlement.
