Respected SIr
My sister as a tenant occupied the house at Bangalore on monthly rental of Rs 11,000/- with advance payment as 80k.
She use to pay rent by cash. She did not enter to into the written agreement. Now the owner is constructing first floor of his house causing inconvenience to my sister family. When i asked him to return the advance so we will vacate the house. He is giving false promises.

Send the legal notice stating your inconvenience about the construction, your intention to vacate the premises as per notice period if any and finally state about the refund of the deposit amount and his false promises.
Keep all records of your payment with regards to house like, electricity bills, water bills, municipal tax notices/payments if any, telephone bills on the house address etc,.

Have your sister any proof of having paid the security deposit / advance payment?
If so, she can proceed legally to recover her money.

You may give written notice to vacate along with copy of receipt for advance. When owner fails to return the advance you may think of issuing legal notice as advised by experts
