Partition petiton without site plan

(Querist) 03 August 2016 This query is : Resolved
Dear friend,

if the suit property is in possession of adverse party, then in this stage, we can file suit without site plan ?
R.K Nanda (Expert) 03 August 2016
File site plan with approximate measurements with partition suit while exact one can be filed later on court orders.
Advocate Bhartesh goyal (Expert) 03 August 2016
Site plan is not basic document so suit for partition can be filed without it.
adv.bharat @ PUNE (Expert) 03 August 2016
Agreed with expert opinion.
Before filing suit exact measurement is not required once court made order then exact can be filed by SMS.
Devajyoti Barman (Expert) 04 August 2016
Site plan is not required to file partition suit or any other civil suit.
After filing it you can apply for survey passed commissioner to make visit of the locale and prepare the site plan. That would be more authentic and worth relying upon by court also.
Rajendra K Goyal (Expert) 04 August 2016
Agree with the expert Devajyoti Barman.

Sir,
Suppose, we are legal heirs, but mutation has entered and sanctioned in favour of opposite party with fraud way in revenue department, then can we filed suit for partition by other legal heirs, whose name not entered in revenue department.
