Sir

i am defendant in civil suit and the stage is Cross of PW1 is completed and after my evidence my (DW1)cross partly pending, now as PW1 also agree in his cross that notice not served to file present suit which was also covered in my Written statement then if now i file petition under Order 14 rule 5 r/w 151 of cpc OR 9A then it will be consider by court for framing of Issues ?

pls guide urgently

Suit filed in Telangana state so 9A cpc applicable or file petition under 14 r 5 of cpc

Under Order 14 Rule 5 r/w section 151 cpc the court may frame issues at any stage of th e suit even at the stage of examination of witnesses.So you are at liberty to file a petition under Order 14 rule 5 r./w section 151 CPC to frame additional issues
