This query is : Resolved
My father passed away recently and i'm the only child to my divorced parents. The current flat is registered under my name and my father's name holding 50% of shares each, And we didn't mentioned any nominee in the society neither my father has registered any "will", my society chairman has advised me to get Legal Heir Certificate and thereafter he shall proceed to make the changes in the society registrar. As i'm unaware of the Laws can someone advise me on the further process of getting the flat registered under my name to 100%.

It is believed that you are Hindu.
Other legal heirs can relinquish in your favor.
Your own able counsel can help you in completing entire process.

If your parents legally divorced then you have only the legal heir to your father. If your parents are not legally divorced, the share of your father will devolve to all the legal heirs including you.

There could be other legal heirs if your father had remarried.

Mr. Amit,
Your query seems to be your academic question, not a real problem.
If there is any truth, your description cannot be taken as complete, if you don't make mention of the other relatives of your father.
You have also not mentioned, what actually is the problem in getting heirship certificate, if you feel that you are the only legal heir.
You have asked for the further process of getting the flat registered under your name that can only be intimated by the secretary of the society. If unable to understand the process, I have already advised to hire services of some local lawyer to get the formalities completed on your behalf.
