Consumer affairs

(Querist) 07 March 2017 This query is : Resolved
I purchased some groceries, dry fruits and spices from a store in Dehradun which were not found to be fit for human consumption. I have also filed a case with the consumer court. I wish to know if there is any provision under which the Court can examine and issue a certificate describing the actual condition of the items and take the same in its custody?
The items are nearing expiry.

Thanks

Products selling nearing expiry is not illegal.. selling after expiry is offence.. You can contact food and drugs department if you feel any contamination.

Why to repeat?

I took the samples to Food department but instead of taking samples of spoiled items from me they took fresh samples from the store. I was left with no other option but to file the case.

I would like to know if it is mandatory to get an analysis of the contaminated stuff done before its expiry or can the same be handed over to the court ? How will I prove at the time of hearing that the items were in bad condition ( even had worms, fungus, etc.) before their expiry ?

Regards
