Depressed class lands

Dears sir,

We owned DC Land 5.0 acres( The lands assigned to Depressed class people) and we are also the same caste.

In 1976, the said DC Land was acquired under Central Land acquisition act by Government for promotion of some private Industries through SIPCOT (State Industries Promotion Corporation of Tamil Nadu Limited - A Govt. of Tamil Nadu Undertaking)

But now only, it is came to our knowledge
that the lands, once assigned to Depressed class people cannot be used to any other purpose. And also the said DC lands could not be acquired under Central Land acquisition act.

In this juncture, whether we could able to recover the said DC Lands from SIPCOT and what is the procedure.

I don't know your state details but I can understands some facts from your statement
(I will compare your problem from my state because most of the state laws are same but with some variation )

Government allots land to various people under state land revenue code , under it disposal of govt land rules .

Now under disposal of govt. land rules they allot agriculture or specific land to Depressed class or any other name weaker section of society is referred to. They are given privileged because traditionally they or their family never hold any rights in land and to up lift their standard of living.

This reservation and allotment in reality is for up life ment of society so all become equal , comparable to situation where academically weak student is helped by teacher and friends more so he can come to normal student level.

Now while granting such land generally Govt don't make people owner they give land either on lease , or they give some class no. like Class 2 land , Class 1 land. Generally all lands which are given by Govt. are not transferable

While alloting land to specific weaker section they don't market rate because they know they can not afford to spend the money.

So legal situation is Govt. is owner of land and you are lease or some category by which you use the land but can not transfer the land.

When Govt. is owner of land it don't acquire (Purchase) the land but it cancel the allotment or cancel allotment of specific area of the land and give again remaining area to people .

Now your land is taken back which was allotted to you and used for more productive work of setting up industry of Govt.

At this stage through proper channel (Mostly Revenue Dept of Dist Collector) you need to apply for allotment of some other land at nearby place if you are doing farming , or you can ask for getting some govt. job in that industry so your financial position improves.

There are certain rules for it which you need to check from local advocate or person who is good in land revenue matters of your state.

But you need to act fast , don't wait for mango to fall , you need to approach them , meet thesildar collector or other authorities .

At same time you should be aware that their will be many cheaters who will take money (corruption) and cheat you , telling you this and that .

Any how I think I have reached my limitation in ans. your problem

By the way I read again you are telling your land was acquired under Land Acquisition act again ?

Is it correct?

Thank very much for your kind information sir. And I have collected the award copy from revenue department through RTI Act sir.
