Date of birth Differs

In case date of birth in birth certificate is different compared to the SSC/HSC certificate, which is considered as final?

In my case, my original d.o.b is 14-12-1985 which is there in my birth certificate. But in my school certificate my parents registered it as 14-07-1985.

You will have to file a suit for declaration and consequential relief of injunction to make necessary correction in the birth certificate as well as marks card.
Before filing the suit you will have to issue legal notice to the Dist., Commissioner who is the representative of the State Govt., and Deputy Director of Public Insruction of the Dist.,

You will have to issue notice u/s 80 of C.P.C.

Suit for declaration is not necessary. An affidavit to the effect that your actual date of birth as per birth certificate is 12.12.1985 and not as mentioned in the H.S.C./SSC certificate. Affix your photo for the affidavit. This affidavit need to be sworn before a Magistrate. This process is sufficient as you are clarifying that your actual date of birth is as per the birth certificate.

It is difficult to be agree with the opinion of Rao. There is no such procedure in Central Board of Secondary Education Board to change the certificate on the basis of affidavit etc. Only civil court can make declaration and may direct to effect change in the record and issue fresh certificate mentioning the fresh date of birth of such contender.

FORMAT FOR CORRECTION IN DATE OF BIRTH
TO BE SUBMITTED BY THE PRINCIPAL OF THE SCHOOL



The form is required if you want to change your date of birth in your Class 10 Certificate.Below are some questions to be answered in the form.The form is available for download from this link : www.cbse.nic.in/faq/dob_mod_form.pdf

1. Name of the Candidate

2. Name of the Mother

3. Name of the Father

4. Name of the School from where the request for date of birth is being forwarded

5. Initial Class, in which first time admitted in this school

6. Where the candidate was admitted in Class-I

7. Date of Birth as per:

(a) Admission Form in Class-I (copy duly attested to be attached.)

(b) Admission and Withdrawal Register at the first school in Class-l(copy duly attested to be attached.)

(c) Transfer Certificate (No. and date if admitted on transfer from 1 st school (copy duly attested to be attached).

(d) First Admission form in the present school (copy duly attested to be attached)

(e) Admission and withdrawal Register tn the present school (copy duly attested to be attached)

(f) Office copy /attested copy of the list of candidate submitted to the Region/ Board at the time when the candidate appeared for class X examination (copy duly attested to be attached)

(g) Roll No. and Year in which appeared

(d) Whether while sending the list of candidates to the Board.

(e) Whether at the stage of checking of nominal rolls supplied by the C.B.S.E.

As per the examination bye-laws (69.2) request for correction in date of birth will be’ entertained within two years of the date of declaration of result of class X examination. No correction whatsoever shall be made on application submitted after the said period of two years
