T. Kalaiselvan, Advocate (Expert) 07 March 2025
Order 21, Rule 22 of the Code of Civil Procedure (CPC) of 1908 requires a court to issue a notice to show cause before executing a decree in certain cases.
The notice is to be issued when an application for execution is made more than two years after the decree date and also when the application is made against the legal representative of a party to the decree or to an assignee or receiver in insolvency.
The notice gives the judgment-debtor an opportunity to show why execution should not proceed.
