m 21 yrs old...3 guys took my cheque forcefully...n they filled d amount 8 lacs...so now how to save myself...i have already done police complain

First intimate the same to the bank and give a letter of stop payment of the cheque by giving the detials of the cheque and intimate the same to the 3 guys and after issue legal notice to them to return the cheque. You have already filed a complaint, if police didn't act on your complainant file a private complaint in the court. Be quick otherwise you will have to face the consequences.

Well you are on sticky ground. It is defficult to prove that three guys forced you to locate your cheque book first and then forced you to sign unless some complicity on your part. Unless you can give conclusive evidence police complaint etc will not help.Any body can pick holes in your story.

If your story is true and no hole is there, than you need not to worry. If they have taken it forcefully and cheque bounced, you are not covered under perview of sec. 138 N.I. Act. Because if the cheque is bounced, the person will have to prove that he had a legally enforceable debt. As per your story there is no legally enforceable debt on you. So need not to worry, If u r telling a true story.

@ Mr.rajeev - i have already gave letter 2 bank d same day wen dis al happened...i dont have 2 pay dem a single peny one of my friend done basket trading with det guys(share market dubbo) n my friend ran away so they caught me n bitten up me n took ma cheque forcibally after everything happened i told ma dad so v made a police complain...
@ shahikumar - one person is der u has saw det they took ma cheque n passport but he is not ready to give statement at police station he is tellin i wil tell dem orally but wil not give statement as det guys r threatin him

In the absence of Police action, you may approach higher Police Authorities like Commissioner , SP, DSP, DCP informing your story so far and seek suitable immediaTE ACTION to save the hassles of court case u/s 138; Notice of dishonour may also have to be carefully replied with all these happenings narrated therein;
