Regarding noise pollution

On 17.09.2010 Pollution Control Board ordered to Parashnath , A Generator set operator ,to stop its operation till without a clearance from board.But he has kept continue its illegal operation till this date.
Let me advise in the above situation may he be prosecuted with a non bailable warrant ?If yes how?
