(Querist) 24 February 2012 This query is : Resolved
applicant apply for the renewal of the passport. there is a case registered under section 279/336/427 IPC which is pending in the court. The applicant failed to disclose this fact while applying. Now the applicant received a notice for suppression of material fact. The non-disclosure is in the applicant form and it was mentioned to the police officer at the time of police verification.
What should be the explanation to the notice?? Kindly guide to prepare a reply to this notice...

Only you are the best person to tell the exact reason/explanation of such suppression. How can a person unknown of your real reason can suggest you?

You have to mention that inadvertently the information was not disclosed in application form . However said information was disclosed at time of police verification. You had no intention to wilfully surpress facts

Take the inadvertent route only.

Although it seems willful default as there was a column in the form so mind can not escape from facts.Yet the plea can be only of inadvertence. But it would work only when form has been filled by some one else than you where explanation can be that the agent filling the form did not attract your mind to that fact so you could not put it there and signed wherever he asked without reading the columns of the form as you were reposing faith on your agent to be competent in filling the form.

Yes. You have to claim that it was not intentionally done as the said information was duly informed to the police authority at the time of verification.
