ramya is a govt. employee.an attempt on her life was made by ravi for rejecting his love proposal.ramya succumbed to injuries.now, the government issues an order
inducting krishna, ramya's brother, into govt. service on compassionate grounds.what is the legal position? is it constitutionally valid?
Kiran Kumar (Expert) 28 June 2009
well it depends upon the rules and regulations adopted by the concerned govt. in this regard.

every state has its own rules.

appointment on compassionate grounds so far as my knowledge is concerned is not unconstitutional.

Rightly said by Mr. Kiran Kumar.

In several cases on compassionate grounds, the SC has laid down principles such as 'appointment cannot be sought as a right', (2) Department has got powers to frame their own regulating rules.

As such, the validity cannot be questioned in the given case scenario.
PALNITKAR V.V. (Expert) 28 June 2009
it is valid and constitutional.
