(Querist) 22 July 2012 This query is : Resolved
my father had a land.in 1973 westbengal govt asked its land reform office to record statement of all lands afresh which is called lr record.before 1973 record of land is called rs record.rs record is showing that land is in the name of my father.but since my father lived outside westbengal my uncle took advantage of it and during lr record changed it in his name.land was verbally given to my uncle to look after it.my uncle after changing record in his name sold it to another person 23 years ago.six months ago when partition suit case was filed regarding patition of property we came to know that our land has been sold to third party by changing name.my uncle may say that record has been changed by office and he has sold according to records which is in his name and that he has no hand in changing record .1)how can it be prooved that my uncle has intentionally and illegally changed record in his name.2)what section of cheating is more appropriate in this case(ipc 415 ipc418 ipc423) which we can file.3)can criminal breach of trust be filed in this case.what are the chances of winning this case

1. If you could prove your title in the property then the evil intention of your uncle in selling the land would automatically be prove.
2. All are quite effective depending upon the facts situation of your case.
3. Wining depends upon proof of the case which is unknown to us.
