(Querist) 25 July 2012 This query is : Resolved
My father age 69 yrs under pressure registered his property in his daughter in laws name. My brother had a court marriage and a Muslim marriage later on. Now they are not taking care of my parents and mentally harassing them. What must my father do? He does not have any means of income. Please help

Property can not be taken back without a very time consuming civil suit and that too if it is proved that the transfer was executed under force and duress.

The father can apply for maintenance against his son u/s 125 crpc or under Senior Citizens Act.

Claim 125 Mtn, as rightly suggested by Shri Barman

If Registration within last 3 years, apply cancellation filing civil suit. Builder may sponsor court cost, in partnership, on Exec POA & Rights
