340 crpc application

Respected all,

in the case of DV act-2005

1- In trial court Respondent has submitted application of 340 Crpc which is pending since 8 months on every date next date. what respondent can do in such situation to expedite the matter.

2-can respondent appeal in higher court to expedite the matter or has to wait till trial court considers.

plz guide to come out with this difficult situation even patience does not work when any application remains pending for year

1. File specific petition for hearing in the court.
2. Yes but depending upon the delay caused. A few months delay would not help.

Have patience, this can not go for long.

1.Pray orally to court to dispose said application ASAP.

2.U can appeal but better wait in trial court.
