406 ipc

In a suit u/s 406 ipc against me I was observer since beginining.First all the witness gave their evidence and in last the petitioner gave her evidence on oath.Usually the petitioner gives his/her oral evidence first.I want to appeal in session court.Will it be fruitful.

No. Such appeal shall not yield any result as in criminal cases, no such sequence is required to be maintained as each and every witness has free and separate role to play not interconnected.
