Divine wealth

Guest (Querist) 15 January 2013 This query is : Resolved
What is the rule position for the end use of public money donated to the places of worships by the crores from the declared or undeclared incomes? Can the places of worships be asked to provide info on this through RTI Query?
prabhakar singh (Expert) 15 January 2013
NO!
Sudhir Kumar, Advocate (Expert) 15 January 2013
be clear RTI applies to Govt bodies only.

A retired Govt officer is well expected to know this.

Each trust can use the donation tha way they want for any lawful purpose.

"public money donated to the places of worships "
Let temple trust handle the money entrusted or gifted for God.

Mere hypothetical query in the absence of any instance of unaccounted income or misuse of momey by any place of worship! Also, what is constitutional in such a hypthetical query without any fact/instance?

Better read respective byelaws of the concerned Trust, with reference to which you have posted your query.

TTD , Tirupati was asked to provide info on issue of VIP passes under the provision of RTI Act 2005 but was declined stating that the TTD does not come under the Govt of AP etc. That was the TOI news. I am aware that TTD is an instrumentality of Govt of Andhra Pradesh and there is an Endowment Ministry in the govt of AP . Still it was denied. My question was asked against that back drop. Yes it was my fault to say "public money donated to the places of worships' as pointed out by Sri Shroff. I must thank him for pointing out my mistake. But I am sure lawyers should not be very emotional about such divine money which are being put to gross misuse..by almost all religious Trusts and Mistrusts and the advocates being the LAW OFFICERS OF THE COURTS , in my opinion do have some duties to help the legislatures to redefine minor Gods and Goddesses and their Trustees of all religion so that divine money is not put to misuse.

Mr Haridas,

To be very frank, your problem is that you always try to create problems for you, even if you don't have any of your personal problem with the issue taken up by you.

Even with the present query, your statement clearly reveals that you have taken point from the TOI News, not based on your own experience.

I don't think, you would have donated any money to the TTD, or even if donated, you would have taken money receipt from them, which is duly accounted for by the Trust.

From the spirit of your question, it also reaveals as if you have not visited TTD personally, as even for the Hundi in front the the temple, where the people put their money, the employees of the State Bank of India are always present to continue with counting of money and accounted for directly in to their books in the account of the Trust. They sit in open before the general public, count the money and valuables in the presence of the supervisors of the TTD, prepare bundles of currency notes, weigh the valuable, prepare deposit challans, get signature of the Trust's Officers and send that to their bank from time to time.

So, before making your own presumptions and putting such type of question, you could better have visited the TTD to personally note the deficiencies and only then could have come forward with your question.

Well dealt by Mr Dhingra.

"issue of VIP passes"

Those interconnected important persons also help temple management, and bring donations, that is used for college, hospital and almost free accommodation. what a well managed almost free heavenly facilities.

TTD IS GREAT

Now is Saibaba Shirdi Temple developing to that height.

Encourage them.

Don't suspect and trouble at least Hindu Religious places and their devotee/ adm

Even Indian Parliament & Ministry are not clean, nor Govt give them anything to encourage Hinduism.

Let them do their noble job peacefully. If they are serving and managing the most powerful God, accepted all over the world, You being Hari, and a particle of Great Hari, help his Mandap. , The Great Tirupati Balaji..

Why negative?? Go to Positive thinking...

I got a feeling that some of the members are too sentimental about divine money which is grossly abused in many forms. What is the harm if the divine money is deposited with the consolidated funds of India and all those noble works are carried out by the govt at the state and the centre. Those elected representatives are elected by the majority of the people unlike the trustees who are ordinarily kith and kins of a select sects.
Times of India story is otherwise taken as the gospel truth to slam the govt at the centre as well as at the state which carried a news item that TTD refused to part with information sought by the RTI Activists. I have enquired from the experts the present provision in the constitution to deal with the money recd from the public. I think lawyers community themselves should come out in support of the move to merger all the divine money to the govt exchequers as the elected govt is solely responsible to look after the interest of its people.

Mr. Haridas,

It is not the members, who are sentimental, rather you are sentimental to consider all the worldly troubles as yours own, when you don't have any concern or personal problem with any such matter.

You are a pensioner and have ample time to waste, but not any one or us to reply your pointless queries, when you don't even have even a bit of proof with you to prove your claim or any personal problem with that.

Moreover, you try to link everything to constitutional law, while constitution of India provides the basis for different laws. If you need to know about the provisions of the constitution with reference to all your noble ideas, better buy a copy of Constitution of India and study that. If you find any lacuna in the Constitution, just fire your ideas to the Ministry of Law to modify or enhance such provisions of the Constitution, instead of wasting a lot of time of the members of LCI, who don't have any authority to incorporate any amendment.

In the early years of my service when I raised some observations on systemic failures in the Army I was advised by some of the successful seniors stating "When don't you leave us alone , leave the job and protest against the system?.
Then my answer was " Leave our dear Army to the Dogs?" I have not changed a bit even now in my passion to make our country more livable.

Lawyers in India so far had the divine right to intimidate and irritate anybody and everybody in both sides of offence and the defence. Its nice to see how easily they themselves get irritated when question is asked reminding their social responsibility. It is like Justice Katju who was irritated when RTI query was to be answered by him.
