the DDA flat is in name of deceased husband

of my clientess.she has 3 children,2 sons,

1 daughter,all 3 married.now all 4 want to

sell flat .what documents are needed to

sell flat.

you will have to get the flat transferred in name of legal heirs . enclose copy of death certificate , make application to DDA for trnasfer, execute indemnity bond .

Dear Nandaji,
The Delhi Development Authority (DDA) may be Govt. undertaking body, so , after deceased of your client, all the dependents or legal heir of the deceased person have to obtained succession certificate from Civil Court of law, then all legal heirs names will be entered in the property card of DDA. You have to check up whether, the flats have been given on lease basis or sale basis. If the flats are on lease basis, and if you transfer to some other party, then you have to take NOC of DDA or make a DDA as a consenting party for transfer lease or sale.

The following documents are required to be submitted in case of transfer of allocation of a DDA flat (death case):
a. Affidavit regarding survived legal heirs from the transferee on non-judicial stamp paper of Rs 10 duly attested
b. Relinquishment Deed on Rs 100 non-judicial stamp paper duly registered with the sub-registrar
c. Undertaking from the transferee on non-judicial stamp paper of Rs 10 duly attested.
d. Indemnity bond from the transferee on Rs 100 non-judicial stamp paper duly attested by Notary Public.
e. Original Death Certificate
f. NOC from the employer/govt loan paying agency, if house building advance obtained.
g. Documentary evidence of relationship, i.e., attested photocopy of: school leaving certificate pr passport and ration card
h. For self financing scheme (SFS) flats bank guarantee duly renewed if applicable.
i. Photograph and three signatures duly attested of the transferee.
