Partition

(Querist) 12 August 2014 This query is : Resolved
In a partition suit the sisters & mother were the Plaintiffs and the Defedants are their brother. The preliminary decree has been passed, in favour of the Plaintiffs. Thereafter the mother of the Parties died leaving behind two daughters & three sons as legal heirs. In such a situation the share of the mother/plaintiff has been devolved upon both the parties. How the final decree would be drawn under such circumstances?
R.K Nanda (Expert) 12 August 2014
court will pass final decree as per shares of existing LRS.
Advocate Bhartesh goyal (Expert) 13 August 2014
Each sister and brother will be entitled to get 1/5 share of questioned property and court will pass decree accordingly.
G. ARAVINTHAN (Expert) 13 August 2014
since all parties were on record, mother's share will be apportioned to all legal heirs
Rajendra K Goyal (Expert) 13 August 2014
