Will i get copies of appellant's pleadings along with notice?

(Querist) 14 August 2014 This query is : Resolved
The National Commission (NCDRC) has ordered as follows. I am the Respondent.

ORDER:

"Heard Learned Counsel for the Appellant.Issue notice of Memo of Appeal as well as application for condonation of delay, to respondent returnable on 8.12.2014."

Will I get copies of Appellant's pleadings along with Notice?

Is personal appearance necessary on 8-12-2014?

Thanks.
T. Kalaiselvan, Advocate (Expert) 14 August 2014
You will get a copy along with the notice. You may appear in person or through a lawyer on the date of hearing. But if you do not appear after receiving notice, the the case will be decided in your absence.

Thank you very much. Is it not enough to send my Counter by post? (Instead of personal appearance).

I cannot afford travelling. Will the appellants pay for my travel?
P. Venu (Expert) 14 August 2014
NCDRC may grant you cost if the appeal is rejected. But certainly not the travel expenses.

if u do not receive copy of appeal then u can ask for it on 8/12/14 in court.
T. Kalaiselvan, Advocate (Expert) 19 August 2014
If you have not been served with a copy of the appeal along with the notice, you can demand the said copy on the date of hearing from the court directly.
