Distinguished Panelist,
In the closure report (FRT) the IO has mentioned
Quote
“During investigation examined some persons and recorded their statements and also collected some documents and it could be found that the dispute between both the parties is civil in nature.”
Un-Quote
But no such statements and documents in court record (file).
Also there is no mentioning of a CD disc containing Audio, Video & Photographs along with various documents pertaining to the case submitted by the complainant to the IO in the course of investigation.
FRT Report has been challenged and Ld. court ordered for case diary to be produced on next date. But neither case diary produced nor IO was present hence case was admitted as Protest Petition.
My Query is:
1) Where to find documents collected / submitted by the IO?
2) Whether case diary has any role with the documents / evidence collected by the IO?

The Court is already seized of the matter. It is better equipped than the ordinary person to ensure that the documents are produced.

You won't get documents collected/submitted by the I.O.
Yes case diary has very vital role in passing order in this case

Respected Sir,
The Ld. Court directed for the case diary but it was not produced.
(1) Is this obligatory for the IO to produce Case Diary? (2) Do Ld Court has any role in ensuring the order is complied in toto? (3) Current status is - u/s 202 CrPC, Ld Court has forwarded to the OC of concerned PS for a Police report for the purpose of deciding "whether or not there is sufficient ground for proceeding by the date fixed. The issue of process against the accused be postponed at this stage". (4) The OC has entrusted upon an IO who had made 3 (three) Police Reports in other cases u/s 144(2) involving the complainant in this case and other opposite parties including the OP in this case also. (5) on the date fixed for P.R. the IO sought for more time and next date is fixed after a month's time.
My question - How this Police Report can be worthy when there is a history of Prejudice? How to ensure that real picture is presented before the Ld Court?
