Any penalty or fine to be payable???

(Querist) 06 December 2015 This query is : Resolved
Sir, I have filed a writ petition in High court to remove encroachment in front of my shop which is a public pathway. It is pending. After 3 months i have filed another wp in my wife's name as PIL and got direction order to remove encroachment in that particular public pathway. In the affidavit of my PIL petition,i havent disclose her as my wife.

Now the encroachment has been evicted by municipality.

Is there any penalty or fine payable to court for not disclosing her as my wife in that affidavit and for got order????

Just withdraw your writ petition.

As a matter of fact, there appears to be no penalty for not disclosing the fact. However, as the cause of action already is over, you may withdraw the Writ.
