Physical assault by neighbour

Sir, My family and the neighbour's family are not in good terms for over four months. We had verbal fights a week ago.When my brother was returning home on 21.05.2016 from office the neighbour lady, her husband and mother verbally abused my brother at car parking. When he asked them why do they talk ill that husnband has hit my brother on forehead with key like sharp material and my brother was profusely bleeding got all his shirt covered with blood. we went to hospital immediately and they sent message to police and filed MLC. The police did the enquiry after we came from hospital. by that time the accused left with family and still absconding. Police has registered FIR under Sections 294A and 323. What should we do now. Will we get justice? Please advise Sir.

You shall certainly get the justice. Just keep proper follow up of the court proceedings. Mention all the facts related to the past incidences and the cause of action. Fight strongly. All the best.

How long will UR neighbours keep absconding? They have to turn up at some point of time or the other.U can press for the arrest of the accused and expediate the matter.

Yes Sir. I have informed his employer about absconding and asked him to inform me if he comes to office as his employer is well known to me. The police are only delaying. I heard he is approaching everyone we know through unknown phone numbers for compromise. But i dont want to compromise. i still cry in pain seeing the pictures of my brother covered with blood. I know a Chief official in government. Planning to ask his help for this guy's arrest. I just want to know how whether these sections are bailable. the eyewitnesses are afraid of coming to court. but when the police came to our apartment, one of my neighbour narrated how the incident happened and who is guilty. I have taken pictures, video recorded my bleeding brother and spilled drops of blood all the way upto home. Will these be enough to get him imprisoned Sir? Thank you

The evidence of the eye witnesses is vital for the complaint.The electronic evidences at UR disposal are valid evidences.

Respected Sir, the opposite house guy had cometo his house this evening with some five men and took some important belongings. We we asked the police why they did not arrest him they say he has got bail from court directly and saying will surrender in court directly.what should we do now sir

You will have to follow up the case/ complaint /FIR for proper investigation and producing the accused. Police may manipulate the circumstances and/or weaken your case.
Engage a local lawyer to keep vigil on the proceeding.
