Properity distribution between two brother

dear sir
we are two married brothers living togather now.mom and dad not live. we want live saparate & distribute properity please solve my query as under-
1-we have old properity approx 4 acre agriculture land, how we distributed
2- a newly house constructed . in new house 90% amount expended by me 6% amount expended by my father 4% expended by my brother.how we distributed
3- we have old house which is fully constucted by my father. how its distributed.
4-80% household material brought by me except monthly fixed amount given to daily expenses to my father at home. how its distributed

building in this land but not in any name.

but 90% building made after death of father and mother.

Who died first: Father or Mother?

Do you have any sister?

Is it self acquired property or ancestral in case of Father?

Is mother of Father alive?

It is presumed that the properties are in the name of of your deceased father.
If yes, then the properties shall devolve equally on you and your brother and both will be entitled to 50% share in the properties.
This is legal position. However if there is an amicable settlement and mutually agreed partition the terms so arrived shall also be legal and binding on both the parties provided the same is reduced to writing and get it registered.

‘6% amount expended by my father’= Both Get 3 % each.


‘90% amount expended by me’=Get 45% from brother


‘4% expended by my brother’=Give 3% to brother.

3- we have old house which is fully constucted by my father. how its distributed.


50%each.



4-80% household material brought by me except monthly fixed amount given to daily expenses to my father at home. how its distributed.



Keep all of 80% household items.


Fixed monthly amount given to father= It is pious and moral and legal responsibility of son(s).

Try to have amicable family settlement of the property. Get the settlement registered.

Can take help of elders to arrive at an understanding in the matter. Legal steps would be time and cost consuming, i.e. would have to wait for years for results.
