Sec 160(2) of Railways act

My client wants to confess his guilt in a case u/s 160(2) of Railways act but problem is this in this section sentence can extend upto 5 years,(minimum is not provided)how i can compound/get rid off from this case,is there anything in newly enacted plea barganing.Kindly help

The term "extend up to 5 years" means the punishment can be at the most 5 years with no minimum limit. The minimum can just be for one day also. So, you can try to get the barest minimum of the sentence on the plea that since the accuser has voluntarily confessed his crime, so the court may take a very lenient view in the case.
