(Querist) 30 April 2011 This query is : Resolved 
There is a registered housing society. At ground floor of the society, there is a flat which is presently owned and used by the builder as his office. The builder is paying municipal taxes as per commercial rate. Now the builder is selling the said flat cum office to a homeopathy doctor who want to open his / her polyclinic and consultation office in the said premises.

Can he / she do so?

can he / she open his / her polyclinic at the said premises?

Society is not giving NOC for the registration of the said premises?

is there is any citation of the Hon'ble Supreme Court or any Hon'ble High Court, please provide the same, so that he / she submit to the society and clear rest of the formalities.
