Time for filing of revision

(Querist) 19 September 2011 This query is : Resolved
Dear All,

a special court had been instituted to deal with the matter of NI Act in which hearing dates are being given on three to four days basis, which is commendable, problem is that the accused if wants to challenge any order of the trial court is unable to do so as the time for securing cc of the order takes much more time even after providing facilitations.
one of the accused is having more than 30 cases against him and the trial court is taking 15 cases of the said cases in one day. when application was moved before the trial court to grant time for obtaining cc of the order and filing the revision the same is not being granted and is being rejected with heavy cost, due to which nor he is able to exercise his rights but also is being burdened with cost. (any judgment in support of the accused shall be very helpful.)
secondly the revisional court is vacant since past one month and other judges are not interefering in the revision citing that special court had been formulated and these revision shall be heard by it only.

pls advice

thnks & rgds

On facts it can be said that procedure so established is jumping over bumps that cheque
bounce defender creates. The system has two way problem in these type of cases when it goes slow due to exploitation of procedure ,complainants cry of "justice delayed justice denied" and when system addresses it accused starts crying "justice hurried justice buried". HENCE IT IS NOT ONLY SYSTEM HAS TO BE BLAMED. WE NEED TO BLAME OURSELVES TOO,WHERE HAVING 30 CASES OF CHEQUE TO DEFEND
WE HAVE SOLE INTENTION TO DELAY THE MOVES BUT WE SAY INJUSTICE IS BEING DONE AS WE ARE GETTING DEPRIVED OF FILLING REVISION AGAINST EACH AND EVERY ORDER WHICH IS A GOOD MECHANISM TO KEEP CREDITOR DYE WITHOUT ANY FRUIT OF HIS LITIGATION.

SO UNLESS PEOPLE DEVELOP MORAL NOTHING IS GOING TO YIELD IN THE FIELD OF PENDENCY.
