In case if a shopkeeper or retailer has given us spoiled food stuff or if i have got food poisoning due to that eating stuff, what could be the legal action. Is there any MONETARY FINE for that.

Yes,he can be fine under the Prevention Of Food Adulteration Act, 1954.
Moreover,In Consumer Forum, Filing after complain, you could get compensation by the forum.

Better you file complaint in District consumer Redressal Forum where if it is found that Shopkeeper has sold you spoiled or hazardous food for health then Forum will take action and you will be awarded compensation .

complaint in forum would prove best remedy provided you have proof of purchase from the shop keeper,if the articles were branded join the company also as opposite party.
