Divorce case

hi

i wanted to know...how a wife can proceed where his husband has filed divorce case and wife doesnot want.

and

what is difference between

a) putting maintenance case in domestic violence in criminal court in thane

b) putting maintenance case in domestic violence in family court in thane.

i mean which is better among a and b.

and how much time it takes for approving maintenance case ??

Wife can claim maintenance from both courts at the same time so there is no need to make any difference.

You can claim :
a]in divorce case it self.
b]under 125 cr.p.c.
c]under DV Act too.
d],section 24,25 HMA too.

wife has not willing for divorce mean then he can file a petition for conjugal rights..

Thane Court has FAMILY COURT: having Jurisdiction only for Thane City Municipal area
Thane Court has JMFC/ SD to cater Thane District Rural area, [except thane city]

Both are diff territorial jurisdiction ,depending on residence of wife/ h

The court would give verdict after the conclusion of trial on the merit of the case.

Two different courts can not have jurisdiction on the same matter. Check with local advocate as to where such case can be filed.
