Will holder

(Querist) 26 February 2012 This query is : Resolved
can we file an F.I.R for cheating against the will holder for selling the property or entering in an agreement for sale, because the will holder could not get the property after it went through a probate. And what can we do for the buyer who purchased the property in good faith and given advance?
Raj Kumar Makkad (Expert) 26 February 2012
There is no ground for filing FIR for fraud if will is otherwise genuine. Procedural lacuena do not give right to file criminal case.
Rajeev Kumar (Expert) 27 February 2012
