Co-op soc byelaws

(Querist) 10 September 2012 This query is : Resolved 
Deputy Registrar s office (Thane, Mumbai, Maharashtra) says that according to an Housing Manual published in Oct 2011 (interpretation of chs byelaws) an associate member who is not a joint owner cannot vote, contest elections or be co-opted in the Managing Committee. The registered chs byelaws of our society does not have any such clause. There has been no recent ammendments with regards to this issue. What is the legal stand on this issue?

request the dy registar to forward copy of said manual . no such restriction in 2002 model bye laws
