The payee met and asked drawer to clear his liability after cheque issued by him was dishonoured.The drawer assured payee and asked some time to clear dues.But drawer failed to keep his promise.Payee sent demand notice to drawer which was received back with endorcement "Bar bar ghar jane per nahi milta'.The notice was sent at the correct address of drawer.The drawer somehow managed with postman to avoid service of notice so as he could escape his liability.Now should the payee file complaint? The notice is duly served or not in the eyes of law?

If stakes are high than only proceed otherwise defense will take many many routes like this to delay and defuse the case.

rather than filing criminal complaint and get involved in technicalities file a summary suit . results are faster
