Can a convicted person u/s. 138 N I Act or otherwise continue to be director of the company?

Can a convicted person be MD of a company after completion of his sentence?riven

Better see minutely the bye-laws/memorandum of association of the company especially the chapter Disqualification for becoming MD. If nothing is mentioned therein, in that case it shall not be regarded as a disqualification otherwise generally convicted persons in sch cases is not capable to hold such prestigious posts in a company.riven

Genrally covicted in any crime said prson is not liable to continue as director or M D of company.But in companies M.O.A of company it permits then he willcontinue.
