Division of property

Hi Sir,

My father was a government employee with self acquired property and he passed away without any will.

Will my mother who is the second wife of my father (legally married after demise of his first-wife)be the legal inherent of the property.

She is also the pensioner.

What would be my rights as a unmarried daughter.

Out of the wed-lock of my father with his first wife he has a son and a daughter who are married. What would be their rights.

After the death of your father,your step mother and all his children will inherit the property in equal share.

Section 8 in The Hindu Succession Act, 1956

General rules of succession in the case of males.—The property of a male Hindu dying intestate shall devolve according to the provisions of this Chapter—(a) firstly, upon the heirs, being the relatives specified in class I of the Schedule.

Well advised by experts, on intestate death the legal heirs of the deceased, here, his second wife, children of first wife and children of second marriage will be the legal heirs to succeed the estates of the deceased.
