Dear sir im 26yrs female. Staying chennai. Tamil nadu district. 2 yrs 6 month back me and my family attacked by other 5 persons on public road night 9 clock. Used by tree woods. That time injurd my back side head. I gave a complaint to local police station. But police not take act ion. Opposite party have political powr.police collected 1000 rs cash for fine from me. Realsed me and my family .They said this is petty cash (not sure) . From that day onwards I m getting head pain. Finally last month I took ct scan. In report . I have prolem in left cerebller. Cerebellar vain and tissus affectd . And buljing . Then some infection there from left neck to ear and eyes. So icant do my work also. Doctor adviced me to take a medicine atleast 3 years . Im mentally disbursed. My afficial job totally affected becase of this head pain.
So now I can I give a conplaint to chennai commissioner office and chief minister special celll department. To against that person.
Pls suggest me.
If I gave a complaint wat will happen.

Madame Shalini,
1. You see the limitation bar will obstruct you from filing a criminal complaint again since the incident took place 2 and half years ago.
2. The only way out is that in case after the incident if you have had reported to a hospital for treating your injury and if you have such case outdoor papers then it is possible for you to file a criminal complaint once again based upon the recent medical reports. This complaint can be lodged with the Judicial Magistrate under whose jurisdiction such police station falls and the incident was recorded as a non-cognizable offence. After the recent medical report the instance of assault can be determined as cognizable offence by the Magistrate since the injury over the time has become serious. You have cogent evidences.
2. You can also simultaneously file complaints to the P.C. and the c.M. cell.
3. Do not worry if the assaulter(s) are politically connected. No one is above law. You need the courage to file such complaints before the Magistrate and the P.C.

The event is old. If you have enough proofs about assault by them, file case for compensation with criminal steps. discuss full case with your lawyer.

Advises of expert Mr.Rohit Sharma no doubt are agreeable, but what is not agreeable is that through his advise he is soliciting his business forgetting that this portal is meant for giving free legal advise/opinion and not to canvass business through such acts. One thing must be borne that all other experts are also capable of handling such issues privately, but they don't do that considering the ethics and decorum.
