May day

(Querist) 30 April 2015 This query is : Resolved
Hello Experts
Please let me know whether "May Day" has to be declared as paid holiday to all employees / workers in all sectors in Tamilnadu/India.
I do work in an NGO charitable institution. Two different opinions given by higher officials - 1] May Day meant for workers / Labour class only and not to all employees- not to all categories and also Sector wise restricted ? 2] May Day holiday means for all workers/labours/employees no difference and also no sector wise difference?

Whether paid holiday to be declared or not?

If we work whether we can claim additional wages/salary or not [or ] whether we should not work?

Please clarify NGO's / Charitable offices covered under which set of rules in TN

Employees working in NGO's / Charitable Offices are to be treated as Workers / Labourers or not?

TN has declared "1st May" as "Mayday" and is a public holiday - that means whether it is applicable to NGO's / Charitable Offices?
Most of the NGO's / Charitable Office hold a post called "Social Worker"

Unable to decide / get information. Experts please clarify
T. Kalaiselvan, Advocate (Expert) 04 May 2015
If a person is gainfully occupied in an organisation whether it is NGO or a Trust and has been employed under conditions of employment, he will be termed as an employee under the said organisation for al the purposes. The motive of the organisation which employed him/her has got nothing to with the status of the employee. He is a paid employee and bound by the rules of the state in this regard. The labor laws will duly apply to his employment too. The state government of TN has declared 1st May as a holiday, thus the employees are entitled to the benefits accordingly.
