Query regarding ready possession flat

(Querist) 07 December 2015 This query is : Resolved
Hello Sir,
I have taken new flat in Pune on Jan/2015 in the PMC limit of Pune cooperation.
building completion date is March/2013.
I have moved to new flat but PMC tax is on builder name & he advised to me PAY all tax from March 2013 to March 2016 otherwise Name will not transfer to my Name.
Can you Please guide me in that case.

Thanks,
Shree
Advocate M.Bhadra (Expert) 07 December 2015
You should have purchase paid taxes by the builder. Send a legal notice to the Builder to pay previous taxes, failing which you can file a suit for declaration in civil court to party added PMC and Builder.

If no amicable solution possible, send legal notice.
K.S.Srinivas (Expert) 12 December 2015
Send a legal notice to the builder to clear all the taxes till date of purchase by you.
T. Kalaiselvan, Advocate (Expert) 16 December 2015
The builder cannot force you to pay the taxes for the past years. If he is insisting on this and refusing to cooperate for name transfer, issue a legal notice demanding him to transfer the name immediately after completing all the formalities or you can drag him to consumer forum seeking relief and suitable compensation.
