Car parking charges

I have been parking my car in the open space of the society subject to availability by paying charges as fixed by the society.
Since past some months I have been parking my car in the stilt owned by my friend in the same society and requested the society not charge me as I am not using the open space of the society but my request was not heeded and charging still continues with an assurance that the matter will be solved in the coming AGM. Is this justified,?. Can a society charge under non existing provisions and seek post fact sanction . Expert opinions solicited.

Attend the AGM and present your view point that parking charges are no longer leviable as you are using a Friends stilt for parking and not the open space.and also seek refund of excess charges levied by society even after parking your car in Friends Stilt.

You are parking your car in society premises, even the space is allotted to some other person. In such situation society may not agree to your proposal.
You may wait till AGM.

I agree with the expert opinion and advise of Mr. Rajendra K Goyal, if you are a tenant and the Society Bye-laws/rule so permit.
However, submit your objection in writing (through your landlord) to the Managing Committee much before the member of the Society (your landlord) may raise the issue in AGM.

I am the owner of a flat. The stilt owner pays only tax to the society in which I am parking my car. If he is not charged parking charges when he was parking, why should I be charged. There should not be discrimination. How the society can charge first and then seek post facto sanction. Is there any such provisions existing in the relevant Act.
