Querist : Anonymous (Querist) 22 July 2010 This query is : Resolved
hello, please answer my query.
1. whether the notice sent u/s 80 of CPC to a Govt. office must be replayed?
2.If not replayed or not giving satisfied answer can i file a writ petition to high court or in lower court?
(Notice is for getting reason of delay or neglecting there duty)

the object of 80 cpc is to provide a chance to the govt to settle the proplems without intervention of court.but the govt never replies or takes action after receiving 80 cpc notice.if there is no reply you are free to approach the court.
Devajyoti Barman (Expert) 22 July 2010
Whether replies or not you have every right to file a suit after 60 days.
In writ matters there is no requirement to send notice u/s 80 of cpc. You are required only to send a demand justice notice where even one month time is sufficient.

I fully endorse Mr. D.Barman's view.
