where to file appeal???

Querist : Anonymous (Querist) 23 August 2010 This query is : Resolved 
i have filed a partition suit in Civil Judge Senior Division... along with the said suit.. i also filed EXH. 5 application i.e. Temporary Injunction Application... the said EXH.5 application was rejected by the Judge.... i want to file appeal against that.. where will the appeal lie i.e. in District court or High Court ????? and how????

It depends upon the value of your suit. If an appeal lies against the decree in the suit to the District court,then the appeal against the order in the injunction petition lies to the District Court. Otherwise it is before the high Court.

If the prayer for interim injunction is rejected then against that order miscellaneous appeal lies before the court of District Judge

then you have to approach only the High Court by way of Civil Miscellaneous Appeal.

Dear,
Misc. Appeal lie before the Distt. judge. in the matter of injuction the valuation is not a point to chack the coutr fee bcz the maximum court fee four the injuction is Rs. 500/ only.
