(Querist) 21 September 2010 This query is : Resolved
Sir,
I have a piece of land in maharashtra and i wish to sell the same.I am presently
living in gujarat and it is not possible for me to travell frequently to that place. Therefore I intend to give a power of attorney to my cousin brother who is living in that place. Can I do so? If the registrar will accept the power of attorney and complete the registration?Because somebody told me that I can give power of attorney to only blood relatives. Please advice.

Hello prakash. POA can be given to anyone not only blood relatives. Only the stamp duty differs. the POA has to be compulsorily registered before the sub-registrar.

In AP the GPA in favour of Family members is with less stamp Duty and to third parties at high side , in AP GPA cum Sale Agreement will be executed in favour of the Purchaser on payment of Full consideration .

1. One can appoint any body as he think fit and loyal to him as his Attorney
2. As such, no one can question/ bar his such right.
3. The stamp duty for registering the GPA is depend upon the fact whether the appointment of Agent for consideration or not

G.P.A. can be given to any body, who is fully competent as per the Indian Contract ACt.
