Power of Attorney

Respected expert,

How can we evict a person staying above my flat on the basis of irrevocable power of attorney, as she is causing a lot nuisance via her pet dogs and deliberate leakage into my flat.

You can not evict any body only can take steps to address for your problems.

I agree that legal steps need to be taken, but what is the legal remedy available, can the registrar of cooperative society help in doing so ?

First complaint to society and if society is not taking action move before Registrar.

You have a case in tort law for nuisance Also muncipal rules obligate a keeper of pets to prevent nuisance to their neighbour .If the no of dogs are greater than five she need all her neighbours consent to keep them .incidentally if a power of attorney is coupled with an interest it is irrevocable however what a power of attorney has do with your problem is not clear

Main problem is that this lady who is staying in the flat above mine is constant trouble maker, right from illegal activities like prostitution, causing continuous leakage to my flat and using dogs to create nuisance.

She is staying in the flat above mine on the basis of a power of attorney. That is the reason why I asked as to how can she be evicted from the flat, she is not the owner of the flat.
