NO, department can not do it, if he can not gave sufficent money to mantain his wife or childrens they go to court for mantinance u/ 125 Cr.P.C.

The Wife can make a complaint to the Departmental Authorities concerned. Who will enquire the matter and take disciplinary action, in case the husband is at fault. It is the duty of the government servant to maintain his family properly.
Parthasarathi Loganathan (Expert) 15 October 2010
Since the issue relates to family between husband and wife, escalating the matter to the employer will in no way redress the family needs. Legal solutions are not viable. The matters needs to be settled or resolved within the family involving all well-wishers and close in-laws.
Akhilesh Kumar (Expert) 15 October 2010
remedy is available only u/s.125 of the crpc, but practically it is very hard to determine that what amount should be given for the maintainance..it depends upon the family structure and income of the husband.
On the other hand it creates unhealthy situation for the family and probably it may lead to the seperation.

So think many time before going for the legal remedy find alternative remedy if available...
